St. Maarten Ombudsman completes standard of conduct forums with civil servants


PHILIPSBURG–Ombudsman Nilda Arduin has completed a series of workshops with the various ministries from August 8 to 15. The main focus of the workshops held at University of St. Martin was the application of the various propriety requirements (“behoorlijkheidsvereisten”) and standards of proper conduct. An introduction was given on the role of the Ombudsman in this new constitution and the role of the civil servants in upholding good governance.

These sessions were organised mainly for civil servants who are directly in contact with the public, civil servants who deal with complaints of the public, policy advisors of the various ministries and the various inspectors/bailiffs of the various ministries. Standards of Proper Conduct that were explained included promptness, provision of accurate and active information provision, legal certainty, correct treatment, adequate organisation of services and administrative accuracy.

A press release from the office of the Ombudsman on Tuesday stated that government must reply to requests from citizens within a reasonable time or within the time stipulated by law. The public also expects that government provide them actively and on demand with adequate information and the information should be provided either on request or at the initiative of government.

The Ombudsman also said that compliance with court judgments and legitimate expectations (information/ advices) must be based on a legal instrument. Administrative bodies should also treat citizens with respect and act politely and professionally. Government must also ensure that its administrative management and organisational performance is set up in a manner that ensures proper services to citizens.

Accurate information must be provided to citizens. Participants of the workshops were given the task to solve case studies that further dealt with the standards. These sessions are geared towards maintaining and restoring the confidence of the public in government. At the end of the sessions, an evaluation sheet was given to the participants and the 2012 Annual Report of the Ombudsman was presented to the Secretary Generals or a representative of the Ministery.
